These Terms of Service constitute a binding agreement between you and the Company and govern the terms of use for the services offered on the Website and platform. FundGen is an AI-powered SaaS (Software as a Service) platform for fundraising management for nonprofit organizations. The platform includes tools for ambassador coaching, analytics, campaign management, lead distribution, and automation.
The services provided through the platform are digital services only and do not include physical products.
Pricing for the services is determined based on actual usage or a pre-agreed price set before the campaign begins, as agreed between the customer and the Company.
Payment is made according to the terms agreed with the customer — before, during, or after the campaign, as specified in the individual agreement.
Prices include VAT as required by law. Payment may be made in Israeli Shekels (₪) or US Dollars ($), at the customer's choice.
The Company reserves the right to update prices. Price changes will apply to future campaigns only and will not affect existing agreements.
In accordance with the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Transaction Cancellation), 5771-2010:
You may cancel the transaction within 14 days of the transaction date, or from the date of receiving the disclosure document (whichever is later), provided the cancellation is made at least two business days before the service start date.
Cancellation must be made in writing to support@fundgen.ai or by phone at +972-53-347-6214.
In case of such cancellation, the Company will refund the amount paid, less a cancellation fee of 5% of the transaction amount or 100 ₪, whichever is lower, in accordance with the law.
After the 14-day period, you may cancel the service by written notice. If cancelled after the service has begun, charges will be calculated based on actual usage up to the cancellation date.
The service is a digital service (SaaS) provided online only.
Access to the platform will be activated immediately upon completion of the registration and payment process, and no later than 24 hours from the transaction date.
Use of the service requires an active internet connection. The Company is not responsible for access issues arising from network or equipment problems on the customer's end.
The Company will endeavor to provide continuous and available service but does not guarantee 100% uptime. Planned maintenance will be coordinated in advance whenever possible.
The Company undertakes to provide the service at a reasonable quality and in accordance with the description on the Website.
The Company and/or its representatives shall not be liable for direct and/or indirect damages caused by use of the service, including data loss, revenue loss, or any other business damage.
The service is provided "AS IS". The Company does not guarantee that the service will be error-free or operate without interruptions.
Information and insights presented on the platform, including AI-based recommendations, do not constitute professional advice. Responsibility for using the information lies solely with the user.
In any event, the Company's total liability shall not exceed the amount paid by the customer in the 12 months preceding the event.
All rights in the platform, including code, design, logo, text, algorithms, and AI models, belong to the Company and are protected by intellectual property laws.
Registration for the service grants you a limited, non-exclusive, non-transferable license to use the platform in accordance with these terms.

By using the service, you agree to the collection and processing of information as described in the Privacy Policy.
The Company acts as a data processor when processing personal data on behalf of a nonprofit organization under a service agreement. The nonprofit (as data controller) determines the purpose and means of processing donor personal data.
The Company also acts as an independent data controller for the limited purpose of improving and operating its platform — including service analytics, security monitoring, fraud prevention, aggregated benchmarking, and AI-powered feature improvement. This processing may involve identifiable personal data where necessary to deliver and improve the Service, but the Company uses aggregated or pseudonymized data wherever possible. The Company will never use one organization's identifiable personal data for the direct commercial benefit of another organization. The Company does not share identifiable donor or contact data between organizations. Each party acts as a separate and independent controller for its respective processing purposes and not as joint controllers.
Nonprofit organizations that upload donor data to the platform are required to sign a Donor Outreach Compliance Agreement and Data Processing Terms through the platform before accessing donor management features. These terms govern the specific data processing obligations of both parties.
Upon termination of the service agreement, the Company will, at the organization's choice, return or delete all personal data and confirm deletion in writing, unless retention is required by applicable law.
The Company shall not be liable for indirect, consequential, special, or punitive damages, including loss of profits, loss of reputation, or data loss.
The Company shall not be liable for damages arising from the use of third-party services integrated into the platform, including payment providers and cloud services.
The Company shall not be liable for delays or malfunctions caused by force majeure, including wars, natural disasters, strikes, internet outages, or government decisions.
These terms are governed by the laws of the State of Israel.
Exclusive jurisdiction for any dispute relating to these terms or the use of the service shall be vested in the competent courts in Israel.
